By accessing or using ColdMailer ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ColdMailer provides an AI-powered cold email platform that allows users to connect their own SMTP accounts, manage leads, and send personalized email campaigns.

3. Account Responsibilities

You are responsible for maintaining the security of your account, all activity under your account, and ensuring your use of the Service complies with all applicable laws including anti-spam legislation (CAN-SPAM, GDPR, etc.).

4. Acceptable Use

You agree not to use the Service to: send unsolicited bulk email in violation of applicable laws; distribute malware or phishing content; impersonate others; or violate any third party's rights.

5. SMTP & Email Sending

You are solely responsible for the emails sent through your connected SMTP accounts. ColdMailer is not liable for deliverability issues, account suspensions, or reputation damage resulting from your email campaigns.

6. Payment Terms

Paid plans are billed monthly. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice.

7. Limitation of Liability

ColdMailer is provided "as is" without warranties. Our total liability shall not exceed the amount you paid us in the 12 months preceding any claim.

8. Termination

Either party may terminate at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.

9. Changes to Terms

We may modify these terms at any time. Continued use after changes constitutes acceptance.
